Not all apartment buildings in Thailand are registered under the Condominium Act

Apartment buildings NOT registered under condominium laws do not offer individual ownership over the units. A unit in an unregistered apartment building is generally sold as lease of a specific part of the building. Only licensed apartment buildings registered under the Condominium Act offer freehold ownership and individual freehold ownership unit title deeds.

By SAMUI EXPRESS Staf: The Department of Forest recently sent 130 officials to Samui to check and investigate the alleged land encroachment on the island and prevent more damages done on forest and public lands. It is also looking into the plan of the Land Department to terminate investigation of land title deeds with August.

The Department has divided the officials into 3 teams to investigate land title deeds and documents of land ownerships on Koh Samui. It will put up a sign in the preserved lands and forest immediately after the examination is done.

Foreigners own 100 million rai

Some 100 million rai of Thai land is owned by foreigners, mostly through their Thai spouses or nominees, Auditor-General Sriracha Charoenpanit revealed yesterday. He said if this situation was unsolved, it could lead to later generations of Thais having no land to live on. Sriracha told a seminar yesterday on concealed juristic acts that threats to national security came from: firstly, drug problems ruining people, and secondly, the lack of land for future generations, as foreigners now owned a third of Thai land - about 100 million rai.

Condo projects facing oversupply

City condominium developers may delay construction of their projects launched last year, say property experts.

The developers are facing an estimated supply of up to 50,000 condominium units in greater Bangkok and a 20-per-cent increase in construction-material costs.

Customers who bought units worth Bt30,000 per square metre or less last year could lose their down payments, because the developers cannot continue with the high construction costs.

More protection for buyers of condos

BANGKOK: -- Condominium buyers are to get better legal protection thanks to the amended Condominium Act, under which developers who do not deliver facilities as advertised will be penalised.

The amendment will become effective on July 4. Surasith Sahasthamrangsi of the real estate business promotion bureau of the Land Department said at a seminar yesterday that the new Act would punish de velopers who used misleading advertising to boost sales.
